Terms of Service
Last updated: 28 October 2026
These terms (the “Terms”) form a legally binding agreement between you (the “Customer”, “you”) and GetaBooking Ltd, a company registered in England & Wales (“we”, “us”, “our”), which operates cloudaichatbot.com (the “Service”). By creating an account, embedding the widget, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
The Service is a software platform that provides a customisable, AI-powered chat widget which businesses embed on their own websites to answer visitor questions, capture enquiries and leads, and (where connected) share booking links. We provide the technology only. We are not a party to, and take no responsibility for, the relationship between you and your own website visitors or customers.
2. Accounts & eligibility
- You must be at least 18 and able to form a binding contract, acting for a business.
- You are responsible for all activity under your account and for keeping your sign-in secure.
- You must provide accurate information and keep it up to date.
3. Your content and knowledge
“Customer Content” means everything you provide or connect to the Service — website URLs and crawled pages, uploaded files, pasted text, instructions, branding and configuration. You represent and warrant that you own or have the rights to use all Customer Content, that it is accurate and lawful, and that your use of it with the Service does not infringe any third-party rights or breach any law. You grant us a licence to host, process and use Customer Content solely to provide and improve the Service. You are solely responsible for the knowledge the bot is trained on and for how the bot represents your business.
4. AI-generated content — no warranty
- Responses are generated by third-party AI models using the knowledge you provide. AI output can be inaccurate, incomplete, outdated or unexpected.
- We do not warrant that AI responses are accurate, reliable, fit for any purpose, or free from error, and you must not present them as professional, legal, medical, financial or other regulated advice.
- You are responsible for reviewing and testing how your bot behaves, for any instructions you give it, and for anything it communicates to your visitors on your behalf.
- You are responsible for not entering, and for configuring your bot not to request or rely on, sensitive personal data or special-category data.
5. Acceptable use
You must not, and must not permit anyone to:
- use the Service for anything unlawful, fraudulent, deceptive, harmful, defamatory, obscene or abusive;
- train or operate the bot on content you do not have the right to use;
- use it to impersonate others, harvest data unlawfully, send spam, or breach anyone’s privacy or rights;
- attempt to reverse engineer, scrape, overload, probe, or circumvent limits, security or rate controls of the Service;
- resell or provide the Service to third parties except through the intended white-label use on your own site.
We may investigate suspected breaches and suspend or terminate access without liability.
6. Plans, fees & billing
- Free and paid (“Pro”) plans are offered. Free-plan allowances and limits are described on our pricing page and may change with reasonable notice.
- Pro is billed monthly in advance through our third-party payment processor. By subscribing you authorise recurring charges until you cancel.
- You can cancel at any time; no further payments are taken after cancellation. Except as required by law or stated in clause 11, fees are non-refundable, including for partial months.
- Pro includes a generous monthly message allowance; if your usage approaches it we will contact you to discuss your needs, and we may apply fair-use limits to protect the Service.
- We may change prices with at least 30 days’ notice; changes take effect at your next billing cycle and you may cancel before they apply.
- You are responsible for any taxes applicable to your use except our own income taxes.
7. Service availability & changes
The Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation, message delivery, model availability, or any particular result. We may modify, add, remove or discontinue features at any time. We rely on third parties (see clause 8) and are not responsible for their outages.
8. Third-party services
The Service depends on reputable third-party providers, including cloud infrastructure and AI model providers, email delivery providers, and a payment processor. We may change these providers at our discretion. They operate under their own terms and privacy policies. We are not responsible for their availability, acts, omissions or security, and your use of the Service may also be subject to their terms where applicable.
9. Data protection & Data Processing Agreement
Our processing of personal data is described in our Privacy Policy, which forms part of these Terms. For personal data contained in chats between your website visitors and your widget (“Visitor Data”), you are the data controller and we are your data processor. This clause 9 is our data processing agreement and applies to that processing. We will:
- process Visitor Data only to provide the Service and on your documented instructions (these Terms and your use being such instructions), unless required otherwise by law;
- ensure persons processing it are bound by confidentiality;
- apply appropriate technical and organisational security measures (including encryption in transit and at rest with our hosting provider);
- engage sub-processors (such as cloud infrastructure and email delivery providers) to help provide the Service; by accepting these Terms you authorise our use of sub-processors, we remain responsible for their performance, and a current list of the categories of sub-processors is available on request;
- assist you, so far as reasonably possible and taking account of the nature of processing, with data-subject requests and your security, breach-notification and impact-assessment obligations;
- notify you without undue delay after becoming aware of a personal data breach affecting Visitor Data;
- on termination, delete or return Visitor Data in our control (save where retention is required by law); deleting your knowledge in the dashboard deletes the associated stored content;
- make available information reasonably necessary to demonstrate compliance with this clause.
Your obligations. You are responsible for having a lawful basis and any consent required under UK GDPR to collect and share Visitor Data (including displaying an appropriate privacy notice to your visitors), and for the lawfulness of the instructions you give the bot. The bot requests a visitor’s permission before passing their contact details to you, but you remain the controller of that data once received.
10. Intellectual property
We and our licensors own all rights in the Service, including the software, widget, and branding. You get a limited, non-exclusive, non-transferable, revocable licence to use the Service per these Terms during your subscription. You retain ownership of your Customer Content. You must not remove our proprietary notices except where white-label features are provided on your plan.
11. Suspension, termination & shutdown
- You may stop using the Service and cancel at any time.
- We may suspend or terminate your access immediately if you breach these Terms, use the Service unlawfully or abusively, fail to pay, or create risk for us, other users or the Service.
- We may discontinue the Service as a whole. If we do, we will give reasonable notice where practicable and, for Pro subscribers, refund any prepaid fees covering the period after discontinuation on a pro-rata basis.
- On termination your licence ends, access stops, and stored data may be deleted. Export anything you need beforehand.
12. Disclaimers
To the maximum extent permitted by law, the Service and all AI output are provided without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, non-infringement and uninterrupted operation. We do not warrant the Service will meet your requirements or produce any particular commercial outcome.
13. Limitation of liability
- Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything that cannot lawfully be limited. If you are a consumer, your statutory rights are unaffected.
- Subject to that, we are not liable for any indirect, consequential, special or punitive loss, or for loss of profits, revenue, business, goodwill, anticipated savings, or data, however arising.
- We are not liable for loss or damage arising from AI output, your Customer Content, your instructions, your or your visitors’ actions, third-party services, outages, security incidents, or missed enquiries, leads or communications.
- Subject to the above, our total aggregate liability arising out of or in connection with the Service and these Terms is limited to the greater of (a) the fees you paid us in the 12 months before the event giving rise to the claim, or (b) £100.
14. Indemnity
You will indemnify and hold us harmless against all claims, liabilities, losses, damages and reasonable costs (including legal fees) arising from or relating to your Customer Content, your use of the Service, your bot’s communications with your visitors, your handling of Visitor Data, or your breach of these Terms or of any law.
15. Confidentiality & security
Each party will protect the other’s non-public information. We take reasonable security measures but cannot guarantee absolute security; you are responsible for securing your own account and devices.
16. Force majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including internet or hosting failures, third-party outages, cyberattacks, strikes, or acts of government.
17. Changes to these Terms
We may update these Terms to reflect changes in the Service or the law. We will post the updated Terms here with a new date and, for material changes, give reasonable notice. Continued use after changes take effect constitutes acceptance; if you do not agree, stop using the Service.
18. General
- Assignment: you may not assign these Terms without our consent; we may assign them to a successor or affiliate.
- Entire agreement: these Terms and the Privacy Policy are the entire agreement and supersede prior discussions.
- Severability: if any part is unenforceable, the rest remains in effect.
- No waiver: not enforcing a right is not a waiver of it.
- Notices: we may notify you by email or in the dashboard; contact us at [email protected].
- No third-party rights under the Contracts (Rights of Third Parties) Act 1999.
19. Governing law & jurisdiction
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where you are a consumer entitled to bring proceedings in your country of residence.
